    California Builders Right To Repair Current Law Summary:

    Current Law Summary: SB800 (codified as Civil Code §§895, et seq) is the most far-reaching, complex law regulating construction defect litigation, right to repair, warranty obligations and maintenance requirements transference in the country. In essence, to afford protection against frivolous lawsuits, builders shall do all the following:A homeowner is obligated to follow all reasonable maintenance obligations and schedules communicated in writing to the homeowner by the builder and product manufacturers, as well as commonly accepted maintenance practices. A failure by a homeowner to follow these obligations, schedules, and practices may subject the homeowner to the affirmative defenses.A builder, under the principles of comparative fault pertaining to affirmative defenses, may be excused, in whole or in part, from any obligation, damage, loss, or liability if the builder can demonstrate any of the following affirmative defenses in response to a claimed violation:

    Fort Lauderdale Associate Secures Summary Judgment in Rare Premises Liability Win

    December 22, 2025 —
    Fort Lauderdale, Fla. (October 29, 2025) - Fort Lauderdale Associate Kyle Hollander recently secured a summary judgment victory for his client, Winn-Dixie, in a contested premises liability case. This was a hotly disputed liability case of water on the floor near an ice cooler with surveillance footage of a customer constantly bringing bags of ice to and from the cooler to the register. The plaintiff unknowingly stepped into the area of dripped melted ice and fell. Kyle successfully argued based on the plaintiff’s own deposition testimony and the surveillance footage that Winn-Dixie didn’t have the requisite actual notice. Additionally, Kyle argued that the brief duration the condition remained on the floor was legally insufficient to establish constructive notice under Florida law. The Court agreed, finding that the evidence would not survive a directed verdict and granting summary judgment in favor of the defense. Read the full story...

    Can Anyone Save Gary, Indiana?

    November 18, 2025 —
    On either side of the impeccably refined and classically domed City Hall and courthouse buildings that make up the largely vacant civic core of Gary, Indiana, are two stark white modernist buildings. Both were designed by Black architect Wendell Campbell, a founder of the National Organization of Minority Architects, and built in the 1980s, a time when the industrial city was reeling from job and population losses and desperate to rescue a downtown in full collapse. One of them is a sports and fitness center that’s still in use, but the 83,000-square-foot Genesis Convention Center, built in 1981, has been empty since 2020. The city is currently weighing redevelopment or demolition; one idea has been to use the building’s blank white facade as a canvas for murals and public art. But in a city with at least 7,000 abandoned buildings, there’s no lack of alternative wall spaces. Read the full story...

    Tampa Team Obtains Highly Favorable Verdict for Property Owner Client in Lawsuit over Traffic Accident

    March 24, 2026 —
    Tampa Managing Partner John Rine and Partner Nick Dareneau obtained a very favorable verdict for their property owner client in a Sarasota County trial in a lawsuit arising from a traffic accident. At the end of closing arguments, plaintiff’s counsel requested appropriately $18 million from the jury. The jury returned a net verdict of just over a thousand dollars. The plaintiff was on a scooter and was involved in an accident with an SUV in a parking lot intersection. Our firm represented the property owner. The plaintiffs argued that the landscape vegetation was too tall and violated the sight lines of the two drivers, and that the height of the shrubbery violated the owner’s landscaping contract and a local sight line ordinance. They also argued that the intersection lacked a stop sign in contrast to the other six parking lot entrances, which had stop signs. Read the full story...

    Climate Superfund Litigation: Courts Split on Venue and Intervention in New York and Vermont Cases

    October 27, 2025 —
    Coalitions of Republican-led states, industry associations led by the U.S. Chamber of Commerce, and, most recently, the U.S. Department of Justice are testing “climate superfund” laws that aim to recover billions from carbon majors for climate adaptation costs. Recent rulings in lawsuits challenging the New York and Vermont statutes have split cases across courts and reached opposite outcomes on intervention: In New York, cases are being split between the Northern and Southern Districts and intervention efforts by nonprofits have been blocked, while in Vermont, the district court has allowed environmental organizations to join the defense of the statutes in two cases. Southern District of New York Splits the Cases On September 8, Judge Mary Kay Vyskocil ordered transfer of the Chamber of Commerce’s suit - joined by the American Petroleum Institute, the National Mining Association, and the Business Council of New York State - to the Northern District. The court found the case “substantially similar” to West Virginia v. James, the coalition suit brought by 22 states and four industry groups, and concluded that efficiency and consistency favored transfer under both 28 U.S.C. 1404(a) and the first-filed rule.
